Terms of sale - O.V.A. Foundation.

§1 General provisions

1. These regulations set out the rules for the purchase of products offered by the O.V.A. Foundation via the website.
2. The seller is Fundacja O.V.A. with its registered office in Poland - 30-331 Kraków, ul. Ludwinowska 7, NIP: 6762696552.
3. The Terms and Conditions are an integral part of the sales contract concluded with the Buyer.
4. The buyer can be a natural person, a legal person or an organisational unit with legal capacity.

§2 Offer and orders

1. The products offered by the Foundation, in particular the album „Stanisław Wejman”, are the subject of the sale.
2. The product information on this website constitutes an invitation to conclude a contract and not an offer within the meaning of the Civil Code.
3. The order is placed by:
   • Product selection,
   • adding it to your shopping basket,
   • filling in the order form
   • making payment using the tpay payment gateway.
4. The sales contract is concluded as soon as the Foundation has confirmed acceptance of the order.

§3 Prices and payment

1. All prices are in Polish zloty (PLN) and are gross prices.
2. Delivery costs are indicated separately during the ordering process.
3. Forms of payment available:
   • electronic payments
4. The order is processed once payment has been credited.

§4 Delivery

1. Products are delivered to the address indicated by the Buyer.
2. Orders are processed on working days (Monday to Friday, excluding public holidays).
3. Shipping takes place within 3 working days of payment being credited.
4. Delivery time depends on the carrier and is usually between 1 and 5 working days.
5. The Foundation is not responsible for delays caused by courier or postal companies.
6. In the event that the Buyer provides an incorrect address, the re-dispatch costs shall be borne by the Buyer.

§5 Right of withdrawal

1. The consumer buyer has the right to withdraw from the contract within 14 days of receiving the product, without giving any reason.
2. To exercise your right of withdrawal, you must inform the Foundation by email.
3. The product should be returned intact.
4. The cost of returning the product shall be borne by the Buyer.
5. Payment is refunded within 14 days of receipt of the returned product.

§6 Complaints

1. The Foundation undertakes to supply a product free of defects.
2. If a defect is found, the Buyer has the right to make a complaint.
3. Complaints should be made by email.
4. The complaint will be dealt with within 14 days.
5. If the Foundation accepts the complaint:
   • replace the product with a new one or
   • will return the funds.

§7 Personal data (RODO)

1. The administrator of the personal data is the O.V.A. Foundation.
2. Personal data is processed solely for the purpose of processing the order.
3. The buyer is entitled to:
   • access to data,
   • their correction,
   • request for removal.
4. Data may be passed on to payment and delivery agents only to the extent necessary to process the order.

§8 Final provisions

1. In matters not regulated, the provisions of Polish law shall apply.
2. The Foundation reserves the right to amend the regulations.
3. The regulations shall enter into force on the date of publication on the website.
